These Terms of Use govern access to and use of the Fiatum website and, unless a separate signed agreement states otherwise, certain related services made available through the website. They set out who Fiatum is, who may use the website, what conduct is permitted, how subscriptions and billing are handled, where refund and dispute terms sit, how AI features should be used, and how liability, termination, and governing law are addressed.

Acceptance of the Terms.

By accessing or using the website, you agree to these Terms. If you do not agree, you must not use the website. If you are using the website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Scope.

These Terms apply to the website, public content, demo requests, forms, and any website functionality Fiatum makes available. If you enter into a separate order form, master services agreement, DPA, statement of work, subscription agreement, or other signed commercial contract with Fiatum, that agreement will control to the extent of any inconsistency in relation to the contracted service.

Age verification and business use

The website and services are intended for business and professional use. You must be at least 18 years old to use the website or request services through it. By using the website, you confirm that you meet this requirement.

Accounts and access security.

If Fiatum provides you with access credentials, you must keep them confidential, use them only for authorized purposes, and promptly notify Fiatum of any suspected unauthorized use. You are responsible for activities carried out through your account unless caused by Fiatum’s own breach of these Terms or applicable law.

Permitted use.

You may use the website only in compliance with applicable law and these Terms. You must not:

  • use the website for unlawful, fraudulent, abusive, or deceptive activity;
  • attempt to gain unauthorized access to systems, accounts, or data;
  • interfere with the security, integrity, or availability of the website or services;
  • upload malicious code, harmful content, or infringing material;
  • scrape, reverse engineer, copy, or exploit the website beyond what applicable law or a written agreement permits;
  • use the website to violate another person’s intellectual property, privacy, confidentiality, or data protection rights.
 

Subscriptions, billing, and payment.

Some Fiatum services may be provided on a subscription, project, usage-based, or enterprise-contract basis. Prices, billing cycles, taxes, invoicing arrangements, renewal terms, support entitlements, implementation scope, and any service levels are set out in the applicable order form, proposal, invoice, or signed commercial agreement. Fiatum may suspend access for material non-payment where permitted by the applicable contract.

Refund and dispute policy.

Fiatum does not publish a blanket website refund rule. Any credits, refunds, cancellation rights, termination assistance, or commercial remedies are handled under the applicable customer contract, order form, or other signed commercial document. If you believe there is a billing error or dispute, you should contact contact@fiatum.io promptly so the issue can be reviewed in good faith. Nothing in these Terms excludes any non-waivable rights that may apply under mandatory law.

AI features and disclaimers.

Fiatum may provide AI-assisted features, including workflow suggestions, categorization, drafting support, analytics, forecasting, anomaly detection, and operational automation. AI outputs can be probabilistic, depend on input quality, and may be incomplete or inaccurate. You remain responsible for reviewing outputs and for decisions relating to accounting, tax, compliance, legal, employment, finance, or other regulated matters. Fiatum does not provide legal, tax, or audit advice through the website.

Customer data and privacy.

As between Fiatum and the customer, the customer retains its rights in customer data, subject to the rights needed by Fiatum to host, process, secure, and support the service. Fiatum’s handling of personal data is described in the Privacy Policy and, where applicable, a DPA or customer contract.

Intellectual property

The website, platform, software, documentation, branding, logos, design elements, text, graphics, and other content made available by Fiatum are owned by or licensed to Fiatum and are protected by intellectual property laws. Except as expressly permitted in writing or by mandatory law, you may not copy, modify, distribute, create derivative works from, republish, sell, lease, sublicense, or otherwise exploit them.

Third-party services and integrations

Fiatum may interoperate with third-party software, cloud services, payment services, communication tools, or content providers. Fiatum is not responsible for third-party services or their terms, security, availability, or privacy practices. Use of those services may be subject to separate third-party terms.

Service availability and changes.

Fiatum may update, modify, suspend, or discontinue website features from time to time. Fiatum will use reasonable efforts to maintain service availability but does not guarantee uninterrupted or error-free operation. Maintenance, security events, force majeure, third-party outages, or factors outside Fiatum’s reasonable control may affect availability.

Termination and suspension

Fiatum may suspend or terminate access to the website or related services if you materially breach these Terms, create a security risk, misuse the website, fail to pay amounts due under an applicable contract, or where Fiatum is required to do so by law. You may stop using the website at any time. Provisions that by their nature should survive termination will survive, including those relating to intellectual property, confidentiality, disclaimers, liability, and dispute resolution.

Disclaimers.

To the maximum extent permitted by law, the website is provided on an “as available” basis. Fiatum does not warrant that the website will be uninterrupted, error-free, compatible with all systems, or suitable for every business purpose. Any implied warranties are excluded to the extent permitted by law.

Limitation of liability.

To the maximum extent permitted by law, Fiatum will not be liable for indirect, incidental, consequential, special, exemplary, or punitive losses, including lost profits, lost revenue, lost business opportunity, loss of goodwill, or loss of data. Fiatum’s aggregate liability arising out of or in connection with these Terms or the website will not exceed the greater of the amount paid by you to Fiatum under the relevant website-related service in the 12 months preceding the claim, or EUR 100 if no payment has been made, except where a different limit is required by mandatory law or a signed commercial agreement.

Governing law and dispute forum.

These Terms are governed by the laws of Lithuania, excluding conflict-of-laws rules to the extent permitted by law. Unless mandatory law requires otherwise, the courts of Vilnius, Lithuania will have exclusive jurisdiction over disputes arising out of or in connection with these Terms.
